Article 1 - Purpose and acceptance

As mentioned above, these Terms and Conditions of Use are established so that each user can take into consideration the terms and conditions determined by the site and applications. By the present, any User declares to have understood the terms of the General Conditions of Use of Dpp-portal.eu and Dpp-pocket and to have accepted them without reserve or modification of any kind. However, by continuing their navigation on the Site, the User is contractually bound to these Terms and Conditions of Use which are therefore fully enforceable.

Specific terms

User: any physical person, acting in a non-professional capacity, having access to the Dpp-portal.eu site or Dpp-pocket app and consulting the referenced Products.

Resseler: any commercial site, whose available for sale products are referenced on the Dpp-portal.eu site or Dpp-pocket apps.

MARAJY-TECH: company that publishes and operates the Dpp-portal.eu site and Dpp-pocket app, specializing in the business sector of computer systems and software consulting, registered with the RCS under the number Versailles B 885 305 789, located in HOUILLES (78800), FRANCE.

Referenced products: the products put referenced on the Dpp-portal.eu site and Dpp-pocket apps.

Describy.com Services: any service made available to Users, Manufacturers or Partners on the Describy.com, Dpp-portal.eu site or on Dpp-pocket apps.

Article 2 - Service Describy.com

Describy.com provides a platform that gathers all product informations. The centralised system will help consumers search for the products that best meet their needs via a streamlined website following a well-planned information architecture.

Describy.com helps manufacturers document and publish a wide range of informations about their products. They are made available to professionals and consumers through APIs and a well- designed user interface that facilitates the management of product information.

Describy.com uses documented, comprehensive and easy-to-use APIs that are suitable for all types of businesses looking for product information. We have designed an ultra simple and fast web application to provide you with the best way to efficiently consult product data.

2.2. Product search service

The search service via Dpp-portal.eu is free and does not require any registration. It is a search service classified by category and/or keyword among the offers of the Merchants in order to consult the referenced Products and the Digital Product Passport.

Dpp-portal.eu and Dpp-pocket places at the disposal of the User a redirection link to other Web sites, the Merchant's Web site. Thus, if the User wishes to purchase one of the Referenced Products, he will have to go to the Merchant's site at their disposal.

Article 3 - Responsibilities and guarantees

3.1. Describy.com wishes accuracy in the information provided on the Website Dpp-portal.eu and Dpp-pocket as well as updates in an automated way and daily. But as errors, not depending on our will, can possibly slip, we would like to explain to you certain rules governed by the present CGU.

Any User must take into account that the information provided on the Website is exactly what was communicated by the Sellers or from the websites of the Sellers. Thus, Describy.com cannot guarantee either the reliability or the exactitude of the information relayed. It is the same for the results coming from the data processed in an automated way.

Any guarantee not expressly given in the present CGU cannot be created from the results of research, advice or information obtained through Describy.com. In the case that the information displayed on Desciby.com is not the same as that displayed by the Seller's site, the latter shall prevail.

Prices displayed on the Describy.com Service are not subject to any shipping charges, warranties, or any other charges invoiced by the Seller besides additional services such as delivery charges, VAT, etc. Therefore, it is possible to be charged additional fees to the price displayed on Describy.com.

The actions undertaken by the User are exclusively binding on the User. Describy.com cannot, in any case, be held responsible for actions undertaken on the basis of information concerning a referenced Product and the expenses provided. 3.2. The relations and transactions between the Seller and the User do not engage in any way Describy.com because it is foreign to the clauses binding the seller and the buyer.

Therefore, Decriby.com does not guarantee, expressly or implicitly, the actions of the Users and their opinions are not always exact.

Each User is held responsible for ensuring that their opinions do not contain erroneous and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, of a sexual and profane nature, threatening, or which, in general, violates any regulations in force (especially on advertising, sales promotion, use of the French language, use of personal data), nor any third party rights (especially intellectual property rights and personality rights).

The extent of diffusion of the Website as well as the taking of all precautions for the respect of the legislation in force must be recognized by each User.

• Pay any damages that Describy.com, its subcontractors and suppliers could claim because of the damages caused by the comments published on the Describy.com site.

The removal or the refusal by Describy.com, at any time, of a comment which could be against the laws in force, the present General Conditions and/or likely to infringe the rights of third parties, must be recognized and accepted by each User.

However, in the following cases, MARAJY-TECH declines any commitment:

• Modifications, interruptions, breakdowns and malfunctions of the communication support used, regardless of origin and provenance;
• The temporary non-access to Describy.com caused by technical problems, without taking into account the origin and provenance;
• Any direct or indirect damage caused to the User, resulting from access, management, use, operation, malfunction and/or interruption of the Service Describy.com;
• The illicit exploitation or abnormal use of the Decriby.com site at the initiative of the User;
• Any problem concerning the access to the Internet network, as well as computer attack or hacking, deprivation, suppression or prohibition, momentary or permanent.
• Concerning direct damage caused to a User as a result of a breach of its contractual responsibilities as defined herein, MARAJY-TECH's responsibility cannot be engaged.

Article 4 - Intellectual Property

4.1. Describy.com makes the listing of products, as well as the display of patents, trademarks and logos of sellers on the site just as a presentation and not as recommendations from MARAJY-TECH. This implies that the use of any information related to intellectual property rights does not in any way reflect the fact that the Sellers are associated with Describy.com, either directly or indirectly.

4.2. Except for the intellectual property rights of the Sellers for the benefit of an intellectual creation such as audiovisual products, graphic elements, videos, applications and documents, the other elements displayed on Describy.com related to intellectual property rights such as copyrights, neighboring rights, trademark rights, database producer's rights belong to MARAJY-TECH. All users can use these elements, free of charge, but only for normal use of the Service Describy.com. The commitment not to alter these elements in any way is the responsibility of the Users.

The author of any illegal use of the elements of the Describy.com site is not only liable for counterfeiting but also for violation of MARAJY-TECH's intellectual property rights. This engages the civil and/or criminal liability of the author.

Any User of the Describy.com Service hereby accepts their commitment not to:

• Use the Describy.com Service or query the service for the benefit or on behalf of a third party;
• To carry out an integral or partial extraction of information on the Describy.com site, for commercial purposes or not;

4.5. As a producer of databases, in accordance with the Intellectual Property Code in force, MARAJY-TECH prohibits any extraction and/or reuse of data from the Describy.com site.

4.6 MARAJY-TECH has the legal authority to prosecute persons who have violated the conditions set out in these Terms and Conditions.

4.7. The links provided by Describy.com to redirect Users to sites operated by third parties, in particular those of the Sellers, are inserted for information purposes only.

MARAJY-TECH is not liable for the content, access or use of these sites operated by third parties, or for any damage resulting therefrom. The User is fully and entirely responsible for the decision to activate these links.

Article 5 - Modification of the Describy.com service

5.1. MARAJY-TECH has full authority to modify or interrupt the accessibility of all or part of the Describy.com Service and/or the website concerned.

5.2. MARAJY-TECH has the right to modify all or part of the GCU at any time. Users are invited to consult these Terms of Use on a daily basis in order to be aware of any changes.

Article 6 - Other

If any part of the GCU is subject to a formal or procedural defect, the terms relating thereto shall be null and void and not written, without however calling into question the contract binding Users and MARAJY-TECH.
